ABP News C-Voter Survey: In Maharashtra, the Eknath Shinde faction had staked claim on the name and symbol of Shiv Sena party after forming the government with BJP on June 30 this year. After which the matter first reached the Election Commission, then the Supreme Court and then the Election Commission. Actually, the Shide faction is claiming that it is the real Shiv Sena and it should get the party’s name and symbol.

Shiv Sena chief Uddhav Thackeray had moved the Supreme Court against this claim of the Shide faction. On September 27, a constitution bench headed by Justice DY Chandrachud in the Supreme Court dismissed Thackeray’s application and said the Election Commission would decide who would have the right over the name and symbol of Shiv Sena.

There is a confrontation between the Uddhav Thackeray faction and the Eknath Shinde faction, which is in power in the state, mainly on three points. First, who is the real Shiv Sena? Second- Who will have the election symbol of the party? Third, whether the Shinde faction is constitutional or not? Chief Justice UU Lalit had constituted a five-member constitution bench, comprising Justice DY Chandrachud, Justice MR Shah, Justice Krishna Murari, Justice Hima Kohli and Justice Narasimha, to hear the matter. The matter was referred to the Constitution of the Supreme Court on August 23 last. The hearing was adjourned thrice. Finally, in the hearing held on September 27, the Constitution Bench of the apex court rejected Thackeray’s application.

Now all eyes are on what the Election Commission decides. After the last hearing of the top court, the Shinde faction had written a letter to the Election Commission, informing about the court’s direction, to take an early decision on the matter.
