Mumbai News: Mumbai Police has registered a molestation case against Nationalist Congress Party (NCP) MLA and former Maharashtra minister Jitendra Awhad on the complaint of a woman. Awhad has denied the allegation. He has said that he will resign from the post of MLA in view of fake cases. Just two days ago, he was released on bail in a case of disrupting the show of Marathi film ‘Har Har Mahadev’ at a multiplex in Thane.
The court has stayed the arrest
The Mumbra police on Monday registered a case against Awhad under section 354 (assault or criminal force to woman with intent to outrage her modesty) of the Indian Penal Code (IPC) on the complaint of a woman. Awhad has moved the Thane court for anticipatory bail. Additional Sessions Court Judge PM Gupta will hear the matter on Tuesday, an official said. The court directed Thane city police not to arrest Awhad till the hearing and disposal of his anticipatory bail plea.
According to the FIR, the woman complainant alleged that Awhad pushed her while making way for him during the dispersal of the crowd after the chief minister’s program in Mumbra on Sunday evening. Awhad is the MLA from Mumbra-Kalwa seat in Thane district in Maharashtra. A senior police officer said on Monday night that a case has been registered against the complainant woman under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
What has the speaker of the assembly said on the resignation
Awhad said that he has resigned from the post of MLA in view of the false cases registered against him. He has addressed it to the Speaker of the Maharashtra Legislative Assembly. However, Assembly Speaker Rahul Narvekar said that Awhad had not submitted his resignation to the Speaker’s office, as required by the rules of the House.
Awhad tweeted on Monday, “Police filed two fake complaints against me with charges under IPC section 354. I have decided to resign from the post of MLA. I will fight against such police atrocities against me. I cannot see the murder of democracy in front of my eyes.” He later told reporters that such allegations destroy one’s family life.
BJP demanded to suspend
As the controversy escalated, the Bharatiya Janata Party (BJP) on Monday asked the NCP to suspend Awhad from the party. State BJP chief Chandrashekhar Bawankule said the cases against Awhad, including for disrupting the screening of a Marathi film in Thane, are based on CCTV footage and videos.
The NCP has come out in support of Awhad, who was the housing minister in the Maha Vikas Aghadi (MVA) government. Senior NCP leader Ajit Pawar on Monday said Chief Minister Eknath Shinde should come forward and explain that nothing like this happened as he was present when the crowd was dispersed after an event at Mumbra in Thane district on Sunday evening. Ajit Pawar said, “I would like to say that the way this case (against Awhad) has been registered is wrong, it should be withdrawn.” Should come and tell that nothing like this had happened there. He said that no matter how he becomes the Chief Minister, he represents 13 crore people of the state.
