Panchayat Election: The Supreme Court has given permission for OBC reservation in the civic elections of Madhya Pradesh. The court has asked the State Election Commission to issue notification of elections in a week. The court has also said that 50 percent limit should not be crossed while giving reservation. The Supreme Court has given this order on the basis of the report of the Backward Classes Welfare Commission of Madhya Pradesh. The commission had informed that the study for OBC reservation has been done.
Supreme Court was angry over pending civic polls
Earlier on May 10, the Supreme Court had expressed displeasure over the vacant seats of about 23600 panchayats and urban bodies in Madhya Pradesh for more than two years. The court had ordered to conduct elections on these seats immediately. The court had said that the State Election Commission should issue notification of their elections in 2 weeks to the bodies whose elections are pending. The court had made it clear that reservation cannot be obtained without fulfilling the conditions fixed for OBC reservation. The court had also said that the election cannot be postponed on the basis of fresh delimitation of seats.
The government had applied for re-hearing
The matter was heard again on the request of the Madhya Pradesh government. During this, this report was placed in the court that the condition of studying backwardness, need for reservation and the effect of reservation has been fulfilled. The work of delimitation of seats has also been completed. Justice AM. Accepting this, a bench headed by Khanwilkar approved OBC reservation in panchayat and urban body elections.
