Hearing on reopening of court

In view of this, the bench has adjourned the matter. The bench says that in the affidavit filed by the petitioners, the Enforcement Directorate’s opposition to transfer to the jail outside Delhi has not been taken on record. The bench told Sukesh’s counsel that there was no rush to hear his plea for shifting him to jail outside Delhi. This matter can be taken up when the court reopens. Basant asked for a closer date but the bench has not considered his submissions.

Lawyer said that the client’s life is in danger

Basant has expressed apprehensions about the threat to his client’s life in jail. Justice Kant referred to the order of a vacation bench headed by Justice Bopanna, which was passed earlier this month. In which instructions were given to transfer Sukesh out of Tihar Jail. Justice Kant said, “No one will touch you after Justice Bopanna’s order.”

ED protested

At the same time, the ED had opposed the transfer of Sukesh from Tihar Jail. Also urged the court to prosecute under perjury for making false allegations of torture and assault in the jail premises.,

Jail in fraud and extortion case

Sukesh and his wife are currently lodged in Tihar Jail in cases related to fraud and extortion. He has moved the apex court seeking transfer to some other jail citing threat to his life. Jail officials have denied allegations that he was assaulted inside the prison and said that he did not report any external injury during the medical examination.

The top court, in its order passed on June 17, had said, “In view of the facts and circumstances, without entering into rival arguments, it would be appropriate to transfer the petitioners to some other jail to allay the apprehensions of all concerned.”
