Hearing on Wednesday, the Supreme Court has given an interim stay on the sedition law in a historic decision. The court has asked the central government to consider this law. Along with this, the central and state governments have been asked not to register any new case under section 124A of the IPC. Britain: The sedition law of the British era which India has been carrying for 162 years, in the same UK, the sedition law was abolished in the year 2009 itself. The crime of treason can be traced back to the Statute of Westminster 1275 when the king was believed to have divine powers. It is said that global opinion is against sedition and in favor of free speech.

Australia: In Australia, the country of the kangaroos, the term sedition was dropped from the National Security Legislation Amendment Act 2010 and replaced with references to soliciting crimes of violence.

Scotland: The sedition law in this country was removed in the year 2010.

South Korea: When legal and democratic reforms were carried out in 1988, the sedition laws were also abolished.

Indonesia: Indonesia has also got freedom from the sedition law. Declaring the sedition law unconstitutional in this country, it was said that it was taken from the colonial Dutch masters.

Important points of Supreme Court order

  • In a landmark judgment, the Supreme Court ordered a stay on all pending sedition cases and advised the police and administration not to use this section of the law until the Center completes its review.
  • Chief Justice NV Ramana said, if a fresh case is registered, the parties concerned can approach the court and the court will settle the matter. The Chief Justice said, the central government is free to give directions to the states to stop the misuse of the law.
  • The CJI said, it would be right not to use this provision of law till the review is done. We hope that the Center and the states will refrain from registering any FIR under 124A or initiate action after the review is over.
