During the hearing, Shinde Camp’s lawyer Harish Salve is presenting the points of the proposed hearing on his behalf. Salve is making several points regarding the Speaker’s authority on disqualification and how to carry out the procedure. Demanding a hearing on them.

The CJI asked whether the MLA, once elected, is not controlled by the party. He is only accountable to the discipline of the legislature party of the party. In response, Shinde Group’s counsel Salve said that as long as the MLA is in office, he is entitled to participate in the activities of the House. Even if he votes against the party, that vote will be valid.

In response to this, Election Commission’s lawyer Arvind Datar said that if we have any claim of being the original party, then we are legally bound to take a decision on it. Disqualification from the assembly is a separate issue. We make decisions based on the facts placed before us.

The date of submission of affidavits of both the parties in the Election Commission is August 8. If any party requests him to postpone the decision, then he should consider it. We will consider sending the matter to the Constitution Bench. Will decide by Monday.
